1. Nature of the Service

Long Stay (the “Site”) is an informational directory operated as a community resource. The Site allows third-party animal shelters, rescues, and individuals (“Listing Parties”) to publicly post information about dogs in their care that have been waiting for adoption for an extended period. The Site itself does not own, house, transport, evaluate, train, foster, surrender, or adopt out any animal. The Site is not a shelter, rescue, broker, agent, veterinarian, or behaviorist, and no employee, volunteer, or operator of the Site has personal knowledge of the temperament, medical history, behavior, or suitability of any dog listed.

2. No Verification or Endorsement

All listings, photos, descriptions, contact information, and other content on the Site are submitted by Listing Parties and are provided “AS IS” and “AS AVAILABLE” without verification. The Site makes no representation or warranty, express or implied, as to the accuracy, completeness, legitimacy, licensing status, or current availability of any listing or Listing Party. Inclusion on the Site is not an endorsement, certification, or recommendation of any dog, shelter, rescue, or individual.

3. Assumption of Risk — Adopters and Visitors

Interacting with, meeting, transporting, fostering, or adopting any animal involves inherent and unavoidable risks, including but not limited to bites, scratches, knockdowns, allergic reactions, transmission of zoonotic diseases or parasites, property damage, emotional distress, serious bodily injury, and death — both to humans and to other animals. By using the Site or contacting any Listing Party through information found on the Site, you knowingly, freely, and voluntarily assume all such risks, whether known or unknown, and whether arising from the conduct of the dog, the Listing Party, yourself, or any third party.

4. Release and Waiver of Liability

To the fullest extent permitted by applicable law, you, on behalf of yourself, your heirs, executors, administrators, family members, and assigns, hereby release, waive, discharge, and covenant not to sue the Site, its owners, operators, officers, employees, contractors, volunteers, hosting providers, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action of any kind — including for negligence — arising out of or related to:

• any injury, illness, death, emotional distress, or property damage caused directly or indirectly by any dog listed on or discovered through the Site;
• any act, omission, misrepresentation, or dispute by or with any Listing Party, adopter, foster, transporter, or other user;
• the accuracy or inaccuracy of any listing, description, photograph, medical record, behavioral assessment, or contact information;
• any transaction, adoption agreement, surrender, return, or transfer of any animal, including any associated fees, contracts, or disputes;
• any interruption, error, or unavailability of the Site.

5. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, losses, judgments, fines, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the Site; (b) your submission of any listing or content; (c) your contact, communication, meeting, adoption, foster, surrender, or transport involving any party found through the Site; (d) your violation of these Terms or of any law; or (e) your infringement of any third-party right. This obligation survives termination of your use of the Site.

6. Disputes Between Users

Any disagreement, dispute, contract issue, fee dispute, return, refund request, alleged misrepresentation, behavioral incident, veterinary cost, or claim of any kind between a Listing Party and an adopter (or any other user) is solely a matter between those parties. The Site has no obligation to mediate, investigate, intervene in, or resolve any such dispute, and shall not be named as a party, witness, custodian of records, or third-party defendant in any such matter. Each user expressly waives any claim that the Site bears responsibility for the conduct of any other user.

7. Listing Party Representations

By submitting a listing, the Listing Party represents and warrants that: (a) it has the legal right and authority to place the animal for adoption; (b) all information provided is true and accurate to the best of its knowledge; (c) it will promptly update or remove listings that become inaccurate or for animals no longer available; (d) it complies with all applicable federal, state, and local laws regarding animal welfare, licensing, vaccination, and transfer; and (e) it accepts sole responsibility for screening, contracting with, and supervising any adopter or foster, and for any incident arising from the animal post-transfer.

8. No Liability for Adopter Conduct or Mistreatment of Animals

The Site and the Released Parties have no ability to screen, supervise, monitor, or control any adopter, foster, transporter, or other person who acquires or takes custody of an animal through information found on the Site. Once an animal leaves the care of a Listing Party, the Site has no involvement in, knowledge of, or control over how that animal is housed, fed, trained, disciplined, transported, medically treated, bred, sold, transferred, surrendered, abandoned, or otherwise handled.

Accordingly, to the fullest extent permitted by law, the Released Parties shall not be liable for any neglect, abuse, cruelty, mistreatment, abandonment, injury, illness, suffering, or death of any animal — or for any act or omission of any adopter, foster, transporter, or third party, including but not limited to violations of animal welfare or anti-cruelty laws, breach of any adoption or foster contract, resale or unauthorized transfer of an animal, hoarding, dog-fighting, intentional harm, or negligent care. Any such conduct is the sole responsibility of the person committing it, and any claim, complaint, prosecution, or civil action arising from it must be directed solely at that person and not at the Site or any Released Party. Listing Parties further acknowledge that they, not the Site, are responsible for vetting adopters and enforcing any adoption contract.

9. No Professional Advice

Nothing on the Site constitutes veterinary, legal, behavioral, training, or other professional advice. Always consult a licensed veterinarian, qualified trainer or behaviorist, and an attorney as appropriate before making decisions about adopting, fostering, or rehoming an animal.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. THE RELEASED PARTIES DO NOT WARRANT THAT ANY DOG, LISTING, OR LISTING PARTY IS SAFE, HEALTHY, SUITABLE, LICENSED, OR LEGITIMATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY INTERACTION WITH ANY DOG OR LISTING PARTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL AGGREGATE LIABILITY OF THE RELEASED PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

12. Acceptance

By accessing the Site, browsing listings, contacting any Listing Party, or submitting any content, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use & Liability Disclaimer. If you do not agree, do not use the Site.
